6. Background Verification: Special Processing Provisions
As a background verification organisation, Quinfy is subject to specific obligations that go beyond general data protection requirements. This section sets out those BGV-specific provisions.
6.1 Permissible Purpose
- Quinfy will only conduct a BGV check where the client organisation has documented a permissible purpose, meaning a specific, legitimate reason for the check (e.g. pre-employment screening for a defined role)
- The permissible purpose is recorded in the BGV request and in our system audit log before any verification activity commences
- Quinfy will not conduct speculative, exploratory, or unlawfully motivated background checks
6.2 Candidate Consent
- Before initiating any BGV check, Quinfy requires documented evidence that the candidate has provided free, specific, informed, and unambiguous consent to the check
- Candidates are presented with a clear consent notice explaining: the scope of the check, data categories involved, verification sources to be consulted, who will receive the report, and their rights
- Consent records are retained for a minimum of 3 years
- Quinfy does not accept blanket or pre-ticked consent forms
6.3 Data Accuracy Obligations
Quinfy has a duty to ensure that BGV reports are accurate. Accordingly:

- Candidates may dispute the findings of a BGV report. Disputes are handled within the timelines set out in Section 7 (Data Subject Rights)
- Client organisations are reminded that they must not make adverse employment decisions based solely on an unverified or disputed BGV finding
6.4 Report Access Controls
